Terms and Conditions 

By renting our product, you agree to these terms and conditions:

Payments:

  • Options: Full payment upfront or SHOP PAY, which splits it into 4 payments.
  • Retainer: A retainer of at least 25% of the total balance is required with all orders. This retainer is deducted from the total price of the wedding/event.

Disclaimer:

  • By renting our floral arrangements, you acknowledge that while some flowers look real and are named after real flowers, they may be artificial and only resemble the real flowers they are named after.

Payment Plans:

  • The balance must be paid in full at least 30 days prior to the wedding/event. If not paid, flowers and decor will not be ordered, and the contract may be terminated by Everlasting Arch Designs.
  • If Everlasting Arch Designs decides to continue the contract after this date, a 10% fee will be added to the balance, plus an additional 10% fee for each 7-day period the balance is late.
  • Any extra costs due to late payment will be passed on to you.
  • Additions within 30 days of the event are accepted up to 7 days before the event and must be paid within 24 hours. Availability and pricing will be determined by what is available. Color and style will be matched as closely as possible.

Substitutions:

  • Everlasting Arch Designs reserves the right to make substitutions if the received flowers or decor are not of suitable quality. The proposed look and color scheme will be maintained with flowers of equivalent value. Notification will be given if a dyed flower is used, and we will not be liable for staining to garments.

Terms:

  • Adjustments can be made to the invoice at the time of the initial retainer. Large additions and subtractions are accepted until the balance is paid in full.
  • A guaranteed minimum payment of 85% of the original proposal is required.
  • Liability on the part of Everlasting Arch Designs is limited to a full refund of monies paid minus the retainer fee.

Price Adjustments:

  • Due to fluctuating flower prices, price increases for rentals including fresh flowers may occur. Customers will be notified as soon as possible, and an invoice for the additional cost will be sent, to be paid within 30 days of the event.

Additional Fees:

  • Price includes setup at one location only. Additional fees apply for moving items from the ceremony to the reception or elsewhere. Our team must handle these moves due to insurance coverage.
  • Ensure your venue can accommodate our rentals.

Delivery and Pickup:

  • All orders include delivery, setup, and pickup by 9:00 PM within 25 miles of our warehouse.
  • Pickups after 9:00 PM incur an additional fee:
    • 9:30 PM: $50
    • 10:00 PM: $100
    • 10:30 PM: $150
    • 11:00 PM: $200
    • 11:30 PM: $250
    • 12:00 AM: $300
  • Delivery outside of 25 miles is typically $1.5 per mile but depends on location and whether our movers and/or florist need to set up. Contact us for a quote.

Product Handling:

  • No rentals can be left outside overnight, including altars, arches, backdrops, and floral arrangements. Arches cannot be exposed to rain. In case of rain, we will retrieve the arch early.
  • No one may transport, take down, or move our products without prior written approval.
  • Damage beyond natural wear will incur a charge of twice the rental price. Items not returned within the rental period will be charged four times the rental cost, and you may keep the item. Credit card information is stored securely and deleted once items are returned.

Décor Consistency:

  • All décor must be communicated to Everlasting Arch Designs to maintain consistency. Décor not provided by us is not guaranteed, and necessary alterations will be made to preserve consistency. We are not liable for issues with non-Everlasting Arch Designs décor.

Venue and Location Limitations:

  • We are limited by the rules and guidelines of the venue. Negotiation of these guidelines is the customer's responsibility. We provide technical recommendations only. Reimbursements will not be made for unused items due to venue limitations not communicated to us.

Cancellations:

  • A 90-day cancellation notice is required for a partial refund of the retainer. In emergencies (war, fire, tragedy, pandemic, natural disaster) within 90 days of the event, we will move your retainer to another date free of charge.
  • Retainers will not be fully refunded. Deductions will include payment processing fees, communication time, proposal preparation time, and any event preparation time.
  • Everlasting Arch Designs reserves the right to cancel the contract if obligations cannot be met. Amounts paid, minus actual costs incurred, will be credited.

Arbitration:

  • Any disputes will be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Vancouver, WA. Judgment on the arbitrator's award may be entered in any court having jurisdiction.
